Knowing that the various arrest warrants had not been executed, a local court allowed declaration proceedings against the dismissed Assistant Inspector General (AIG) Raj Jit Singh.

Raj Jeet was dismissed from the Punjab Police on 17 April and nominated in a drug smuggling case by the Special Task Force (STF). The Magistrate’s Court, Jajit Singh, made the observations because the accused did not surrender despite the issuance of multiple orders against him.

The court while adjudicating the application by the STF of the Punjab Police noted that the arrest warrants issued against Raj Jeet were returned without execution. The Public Prosecution Office submitted a request for issuance of notification procedures against the accused.

The Court noted that on perusal of the file it showed that the current flight information was recorded under Sections 21, 22, 29, 59(2) of the NDPS Act, Sections 218, 384, 466, 471, 482, 120-B of the IPC, and Section 25 Weapons Act against the Accused. It added that warrants were issued to issue arrest warrants for the dismissed police officer on May 18, which were not carried out. The court indicated that new arrest warrants were issued on May 31.

On 31 May, an application was filed by the investigation agency for the release of declared offender proceedings against Raj Jeet. On the same day, Counsel HS Danua appeared on behalf of the accused and filed an application under Section 70(2) CPC to set aside the arrest warrants.

The court further noted that on 22 June, the application made by the accused under section 70 (2) of the Code of Criminal Procedure and the application made by the Investigation Agency for Publicity were rejected, and new arrest warrants were issued against the accused on 1 July.

“Since the arrest warrants issued against the accused have been received without the execution of the death penalty, and the accused is also pursuing/challenging the present request through his counsel, I therefore find that there are sufficient grounds to believe that the accused Raj Jeet is concealing himself so that by arresting him he cannot be executed.

The court noted that “in view of this, the present request is permitted by the manner in which a declaration is made under Article 82 of the Code of Criminal Procedure against the accused on August 17.”

If the accused does not surrender until August 17, the court can declare him guilty.
