Texas-based Optis Cellular Technology LLC sued Apple in 2019 over its use of patents that Optis says are necessary for certain technology standards, such as 4G.

London’s High Court ruled last year that two of Optis’ fourth-generation patents were so-called standard core patents and that Apple had infringed them.

Apple appealed that decision in May, arguing that the two patents in question were not necessary for the 4G standards and that they did not infringe the patents.

But the appeals court rejected the appeal, with Judge Colin Pierce saying in a written ruling that the Supreme Court was “right to dismiss (Apple’s) argument for non-infringement” and on the issue of patents as fundamental.

Apple and Optis did not immediately respond to a request for comment.

Tuesday’s ruling is the latest decision in the legal battle between Apple and Optis, which began in 2019 and has led to six separate trials and several hearings in Britain alone.

An appeals court last month upheld an appeal by Optis against an earlier decision to invalidate two more patents related to 4G networks, following a ruling in October that Optis was entitled to issue an injunction to prevent Apple from infringing its patents before the court ruled on the show. and reasonable and non-discriminatory terms of use.

Apple was granted permission earlier this year to appeal against the October ruling.
