A letter from the Union Public Service Commission to Haryana via a panel of senior IPS officers to choose from the next state police chief has put the government in a bind with the central agency now demanding details related to former DGP Manoj Yadava, whose name has been included in the list. UPSC also requested additional clarifications and documents related to some of the officers on the team.
The Haryana government initially sent to UPSC a panel of 10 IPS officers to select the new Director General of Police as the current Chief of State Police, PK Agrawal, is retiring on 15 August. The painting did not contain the name of Yadava, the most senior IPS officer of the Haryana cadre. Yadava, who is currently seconding as Director General (Investigation), National Human Rights Commission, had pledged to the state government that he did not want to return to Haryana to lead the force.
However, UPSC has now sought more details from the state government regarding Yadava, who remained in the Haryana DGP from 2019 to 2021. A source familiar with the development said UPSC has sought details regarding Yadava citing Supreme Court directives and undertakings from the Ministry Union Home Affairs (MHA) states that officer approval is not required for appointment as a state DGP.
As per the directives of the Supreme Court in the landmark judgment of Parkash Singh in 2006 and the guidelines of the MHA, the DGP will be selected by the state government from among the three senior officers appointed for promotion to that rank by UPSC on the basis of length of service, career record and experience group. It is not necessary to have the desire or consent of the officer being considered for the position of DGP.
UPSC sought Yadava’s integrity certificate, his confidential annual report and employee biometric file/data. More documents related to the officers mentioned in the painting have also been sought by the UPSC.
Additional Principal Secretary (Home) TVSN Prasad shall respond to clarifications requested by UPSC.
The IPS officers whose names were sent to UPSC on July 11 are R. s. Mishra and Muhammad Aqil (both Class of 1989); Chattrujeet Kapoor and Desh Raj Singh (Class of 1990); Alok Kumar Roy and SK Jain (1991); O. P. Singh and Ajay Singhal (1992); and Alok Mittal and AS Chawla (1993). However, Jain’s name was later deferred due to negative entries in his service records.
