A few days after the Kasauli Cantonment authorities asked shopkeepers at Pine Mall Market, popularly known as Tibetan marketTo vacate unlawfully encroached premises, shopkeepers moved Solan District Court which granted a temporary stay until 25 July.

The ten-day period to vacate the area was scheduled to expire on July 20, after which the army was scheduled to mount an anti-trespassing campaign to remove the shopkeepers. Next session on July 25th.

Some time ago, a local resident moved the Shimla High Court for encroaching on Pine Mall, claiming that 21 stores were built illegally. The Supreme Court asked the authorities to provide a response as soon as possible.
According to the sources, the hearing of this case is scheduled to be heard before the Shimla High Court on July 24, where the matter will be heard.

Balram Sharma, counsel to the government in the Shimla High Court, who is fighting the case on behalf of the Kasauli camps and the government authorities, claimed that he was unaware of any accommodation granted to the trespassers of Pine Mall.

Eighteen of the 21 store owners at Pine Mall Market moved the Sullan County Courthouse, seeking help in the matter. After their plea, a temporary exemption was given until 25 July.

The army camp recently issued notices to 21 shopkeepers in the Tibetan market to vacate the encroached area from the army camps within 10 days or face action.

The shopkeepers in the market claimed that “the Solan District Court ordered the suspension because they stated in their pleadings that proper procedure was not followed to remove the infringement.”

A little rest, say the shopkeepers

Talking to Indian ExpressA shopkeeper at the Jain Tea Stall said, “We are opening our shops very late these days due to the lack of tourist influx after the fury hit by the recent monsoons. The stay brought us very short relief.”

Another shopkeeper, Sapna, who runs a momos shop in Tibetan Market, said, “Some of the wise men among us took this step which brought us short-term relief.”

Talking to Indian ExpressAn official with the Cantonal Council said, “It was in 2002 when the Solan District Court was moved by the shopkeepers in the Tibetan market against the trespassing campaign. Then the court decided in favor of the eviction of the military camps.”
