A federal appeals court ruled on Tuesday that the US government cannot prevent people convicted of nonviolent crimes from owning guns.
The 11-4 ruling by the Philadelphia-based US Third Circuit Court of Appeals is the latest defeat for gun control laws in the wake of supreme court A ruling last year expanded gun rights across the country. The decision stems from a lawsuit filed in 2020 by a Pennsylvania man, Bryan Mountain Range, who was barred under federal law from possessing a gun after pleading guilty to welfare fraud. Federal criminal law generally prohibits people convicted of crimes punishable by more than one year in prison from possessing weapons. Such offenses are usually felonies, but the law also includes some state misdemeanors, such as ring misdemeanors.
Last June, the Supreme Committee ruled that the Second Amendment protects the right of individuals to bear arms in public for self-defense, and that any restrictions on that right must be consistent with the United States’ historical tradition of gun regulation.
