The Association for Democratic Reform (ADR) on Monday sent what it described as a “deliberate act of contempt” by political parties, to the Election Commission requesting action against parties that fail to publish details of candidates’ criminal pasts as per the Election Commission’s orders. The Supreme Court had on September 25, 2018 directed all political parties to publish details of their candidates’ criminal histories, including the reason for their selection. After hearing a contempt plea over failure to enforce its order, the Supreme Court on February 13, 2020 directed the parties to list the reasons for naming these nominees within 72 hours of their selection. The European Commission issued directives to the parties on 10 October 2018 and 6 March 2020 in compliance with the Supreme Committee’s orders, making it mandatory for all parties to publish details on their websites.
The Dispute Settlement Association said it had again moved the court to raise the issue of the parties’ non-compliance with previous orders. She said the court directed the DSA on March 17 to “pursue remedies before the Election Commission,” which led to Monday’s letter to the three-member panel.
“It is against this backdrop that ADR is seeking to crack down on the ailing political parties, which contested the 2023 Assembly Elections held in Tripura, Meghalaya, Nagaland and Karnataka, the 2022 Assembly Elections held in Gujarat, Himachal Pradesh, Uttar Pradesh, Uttarakhand, The letter said that Goa, Manipur, Punjab and 2021 assembly elections were held in West Bengal, Tamil Nadu, Kerala, Assam and Utah in Puducherry.
ADR said its analysis of Forms C2 and C7, which contain criminal antecedent information in a specific format published by parties from 2021 to 2023, showed that many parties “regardless of their current political outreach and popularity, have not had an effective website to post details.”
