The trial in an alleged racketeering case against former Mumbai Police Commissioner Param Bir Singh will remain pending after the Magistrates Court on Wednesday accepted a CBI petition to postpone the trial.
The FBI had approached the court in May saying that because additional investigation was ongoing, it was necessary to suspend or postpone the trial until the investigation was completed.
The Magistrates Court allowed the plea to be suspended stating that the case will remain pending until the CBI files the indictment.
The Supreme Court in March 2020 had directed that the proceedings and investigations into five outstanding preliminary information reports against Singh be transferred to the CBI of the State Police.
In one of the five cases, the FIR was recorded by the Crime Branch of the Mumbai Police investigating extortion on the basis of a complaint made by Bimal Agarwal, who alleged that at the request of the former Chief of Police, then Sub-Inspector of Mumbai Police, Sachin Wiz, he had extorted 9 Thousands of rupees of it in December 2020 to March 2021.
The indictment lists Singh, Wiz, Sumit Singh and Alepesh Patel as accused.
This was the only case in which an indictment was filed against Singh.
In May, the court released Singh on bail after he appeared before it. The court considered that two of the other defendants whose case had been booked had been released on bail earlier.
On Wednesday, Waze also filed for bail with the Magistrates’ Court.
His plea stated, “Given that court proceedings have been kept pending by order of the prosecution, there is no prospect of a trial starting any time soon.”
The petition said Waze should also be eligible for a benefit under Section 436A of the Code of Criminal Procedure, whereby if a person is held for more than half of the maximum sentence of the sections under which they are booked, they can be released on a personal bond.
The petition states that he has been booked under Sections 384 and 385 of the Indian Penal Code relating to extortion where the maximum penalty is three years.
The court asked the CBI’s opinion on the petition.
Waze has been in custody since March 2021 in connection with the Antilia terrorist intimidation and Mansukh Hiran murder case.
