A site engineer and contractor who were carrying out earthworks for a construction company were arrested on Thursday for negligence after the work allegedly led to a large dam in the road near Magathan metro station on Wednesday.

However, the Kasturba Marg police station staff, who booked the duo on a complaint from the Brihanmumbai Municipal Corporation (BMC), refused to disclose the names of the arrested engineer and contractor. They were later released on bail.

“Based on the FIR submitted by BMC, the accused have been charged under Section 34 of the Indian Penal Code (acts of several persons in furtherance of common intent) and 336 (negligence endangering human life),” said the Chief Inspector. Anil Afhad of Kasturba Marg Police Station.

The inspector added that the accused appeared before a court in Borivali where they were released on bail.

According to officials of Maha Mumbai Metro Operation Corporation Limited, a stormwater drainage chamber near the entrance/exit of Terminal 2 is in close proximity to the foundation of stairs and escalators.

Due to deep excavations made by the builder near the exchange chamber, its wall was damaged. This led to rainwater flowing into the excavation area, officials said, posing a potential risk of further collapse of the drainage chamber and the foundation of staircases and escalators.

Repair work continues even as the elevator and stairs to the metro are closed to pedestrians for safety reasons.
