ISLAMABAD: The Islamabad High Court on Tuesday night upheld the ruling Imran Khan arrestedsaying that all legal procedures were carried out by the National Audit Bureau (NAB) as he arrested the former prime minister, dashing the hopes of his party.
The court handed down its reserved verdict, which enraged the Pakistan Tehreek-e-Insaf (PTI), which claimed the arrest was illegal and that the Supreme Islamic Court would pass its verdict in favor of party chief Imran Khan.
The Islamabad High Court on Tuesday summoned top officials and police officers after the paramilitary Rangers arrested former Pakistani Prime Minister Imran Khan in a corruption case from the seat of the court but kept its verdict.
The arrest of the paramilitary Rangers was observed by Chief Justice of the Islamabad High Court Aamir Farooq when the PTI chief was present in court on the occasion of his biometric presence before the start of the hearing in a corruption case.
Khan, 70, who had traveled from Lahore to the federal capital Islamabad, was arrested after the Rangers broke open a window and arrested him after beating Khan’s lawyers and security staff.
The arrest of the cricketer-turned-politician comes a day after he accused the powerful military of making baseless allegations against a senior officer of the ISI.
The IHC summoned several officials and heard arguments about the merits of the arrest and if it was lawful to arrest someone present inside the court.
After hearing the case, the presiding judge retained the judgment.
The presiding judge initially ordered the Home Minister, the Inspector General of Islamabad Police and other officials to come and respond to the arrest within 15 minutes.
The presiding judge added that he had shown “restraint” in the matter and warned that the prime minister would be summoned if the Islamabad police chief did not attend.
Judge Farooq said, “Come to the court and tell us why Imran was arrested and in this case.”
IG Akbar Nasir Khan duly appeared in court and said that NAB had arrested Khan in a case involving him and his wife Bushra Bibi for alleged corruption.
Khan’s lawyer, Faisal Chaudhry, told the court that the PTI chief was illegally arrested when he was present inside the court to record his biometric attendance.
Lawyer Gauhar Khan, another lawyer for Khan, claimed that the cricketer-turned-politician was hit on the head with an iron bar and injured his leg during the arrest.
Khwaja Harris, Khan’s other lawyer, said the court should take action against NAB as Khan was arrested from inside the court, which is a contempt of court.
After hearing the lawyers, the presiding judge summoned the NAB officials before taking a break. When the court reconvened, Director General Nab Rawalpindi Mirza Irfan Beg appeared with Deputy Attorney General Nab Sardar Muzaffar Abbasi.
Abbasi told the court that the anti-corruption watchdog had its legal right to arrest Khan, who did not join the investigation into the case.
“The accused can be arrested from anywhere if there is resistance,” he said.
Attorney Harris defended NAB’s argument by saying the arrest was made in violation of the rules and the court should take action.
“The court should overturn the arrest as it is unlawful and order the NBA to release Imran Khan immediately,” he said.
Supporters of the former prime minister stormed the Pakistan Army headquarters in the garrison city of Rawalpindi and the Corps headquarters in Lahore after Khan was tragically arrested.
Khan faces a slew of issues since his overthrow by a vote of no confidence in April last year. All of these issues were dismissed as political victims by the ruling coalition.
Currently, Khan said he is facing more than 140 cases related to terrorism, blasphemy, murder, violence and incitement to violence.
