A day before the Supreme Court is due to deliver its ruling on a disqualification appeal against 16 MLAs of Prime Minister Eknath Shinde led by Shiv Sena on Thursday, both the ruling and the opposition factions said they were confident that justice would be done.
Sanjay Raut, UBT MP Shiv Sena said, “It will be decided whether or not democracy is alive in this country or not tomorrow (Thursday). The referee will also decide if our judicial system is working under any pressure. Is our constitution burning like the constitution Pakistan? We’ll find out about this tomorrow.”
He added, “The decision of tomorrow’s court is very important. Tomorrow, the country will be judged.”
Reut said, “We will get justice. If democracy remains in the country, we will get justice tomorrow. We believe that the judiciary is independent.”
Raut also said Maharashtra Assembly Speaker Rahul Narvikar should resign from his post
Responding to Raut’s statement, Narvikar said, “Sanjay Raut makes such irresponsible remarks because he has little knowledge of the constitution and has not read the provisions of the law. I think people should forgive him (for his comments).”
Sena (UBT) leader and former minister Aditya Thackeray said he fully trusted the judiciary and said Shiv Sena (UBT) had challenged the appointment of Speaker Rahul Narwekar as well. “Whether an unconstitutional president sits is also one of the issues before the Supreme Court. I don’t know how the Speaker of the House can comment on the Supreme Court ruling with so much certainty.
Maharashtra Assembly Speaker Rahul Narvekar on Tuesday said that as per the law, the decision to exclude mutual legal assistance can only be taken by the Speaker of the Legislative Assembly and no other constitutional body can take such power from the Speaker.
If such treachery, like the one in Maharashtra, is legalized, there will be political instability in the state. All sides will have problems. I have complete confidence in the judiciary. The prime minister is illegal and unconstitutional. We have waited for several months and now we need to wait 24 hours and the whole picture will clear up,” Aditya said.
Maharashtra state Congress chief Nana Patol said the party expected the ruling to be in line with the tenth schedule of the constitution. “All 16 MLAs will be disqualified and this government will fall,” he said.
The Supreme Court ruling will have a long-lasting impact on democracy and the democratic process in the country. “We expect a ruling like this that will strengthen the Indian constitution,” said Mahesh Tapas, the main spokesperson for the National Congress Party.
On the other hand, Deputy Prime Minister Devendra Fadnavis said they hope the verdict will be in their favour. “We are optimistic because our case is strong and we expect the correct application to be delivered. In fact, we should wait for the verdict and not speculate.”
Abdul Sattar, a minister in the Shinde government, said, “Just as we get the name of the Shiv Sena and the symbol of the party, we will get a ruling in our favour. However, whatever the ruling is, we welcome it.”
Although 40 MLAs had rebelled and switched to the Shinde camp, only 16 MLAs had been given disqualification notices. The reason is that when Shinde Uddhav Thackeray ‘scammed’ on 20 June 2022, the former was accompanied by 11 MLAs who first went to Surat and later to Guwahati.
A day later, these 12 MLAs did not attend the meeting held by Thackeray. So, initially, the Shiv Sena led by Thackeray filed a petition demanding the removal of 12 MLAs for violating the party whip. Later, they sent out notices to four more MLAs, bringing the total number to 16 MLAs. While the total number of MLAs who have pledged allegiance to Shinde has risen to 40.
