The Board of Justices JK Maheshwari and PS Narasimha told Personal Advocate Jaya Sokin that the Court understands why and how this petition was filed and is not inclined to accept this petition under Article 32 of the Constitution

The Supreme Court on Friday refused to accept the Political Isolation Act seeking direction to the Lok Sabha Secretariat for President Draupadi Mormo to inaugurate the new Parliament House.

The Board of Justices JK Maheshwari and PS Narasimha told Personal Advocate Jaya Sokin that the Court understands why and how this petition was filed and is not inclined to accept this petition under Article 32 of the Constitution.

Under Article 79, the president is the chief executive of the country and she should have been invited, Sokin said. However, he said that if the court does not want to accept the petition, he is allowed to withdraw it.

Solicitor General Tushar Mehta, who is representing the Centre, said if the petition is allowed to be withdrawn, it will be taken to the Supreme Court.

The council then dismissed the petition as a denunciator.

The petition said the defendants – the Lok Sabha Secretariat and the Union of India – were “insulting” the president by not inviting her to the inauguration.

The petition was filed by Supreme Court lawyers amid controversy over the scheduled inauguration of the new Parliament House by Prime Minister Narendra Modi on May 28.

Twenty opposition parties decided to boycott the ceremony in protest of the “marginalization” of the president.

In a joint statement on Wednesday, 19 political parties said: “When the spirit of democracy was taken away from parliament, we find no value in a new building.” The Bharatiya Janata Party-led NDA responded, denouncing the “derogatory” decision.

“This act is not just disrespectful; it is a flagrant affront to the democratic spirit and constitutional values of our great nation,” parties affiliated with the ruling National Democratic Assembly said in a statement on Wednesday.

The President of the Lok Sabha, Om Birla recently met with the Prime Minister and invited him to inaugurate the new building. Modi also laid the foundation stone of the building in 2020 and most opposition parties have stayed away from the event until then.
