The Supreme Court noted on June 12 that the accused suffers from life-threatening illnesses that require immediate medical attention and post-operative care.
The Supreme Court on Wednesday dismissed an urgent hearing on an appeal by the Enforcement Directorate to challenge the Delhi High Court’s order to grant temporary bail on medical grounds to liquor tycoon Sameer Mahendru in a money laundering case relating to alleged irregularities in the now scrapped Delhi tax policy.
The matter has been brought before the Court of Justice Surya Kant and Judge MM Sundreich with Solicitor General Tushar Mehta, who are appearing before the Emergency Department, seeking an expedited hearing.
“Someone has been released on bail … people are languishing in prisons,” the court said.
The Supreme Court on June 12 had noted that the accused was suffering from life-threatening diseases that required immediate medical attention and post-operative care. “Everyone has the right to receive appropriate and effective treatment,” she said.
The court imposed several conditions on Mahendru, including that he would not leave the confines of the hospital and his home, nor would he leave the country.
The ED has registered an Enforcement Case Information Report (ECIR) against Mahendru under the Prevention of Money Laundering Act (PMLA).
The money laundering case stems from an FIR report registered by the CBI into the alleged fraud in the now abolished Delhi Tax Policy.
The CBI and ED alleged that irregularities were committed during the amendment of the excise policy and undue benefits were provided to license holders.
The Delhi government implemented the policy on 17 November 2021, but canceled it at the end of September 2022 amid allegations of corruption. Former Delhi Deputy Chief Minister Manish Sisodia is also accused in the case.
