The Mumbai Consumer Court recently awarded a refund of Rs 11.65 crore with interest to a buyer of a flat who booked an apartment in World One after it was no longer the tallest building in the world.

According to a FPJ reportthe consumer argued that the building being the tallest in the world was the only reason to buy the house, which is no longer the case.

The buyer had been paying installments for the apartment until then, however, when the apartment was not the tallest, he stopped further payments for the apartment he had booked on the 38th floor.

Upon protest, the purchaser proceeded to consumer court and claimed possession of his apartment in ‘World One’ with all 117 floors constructed with all applicable permissions from the authorities along with late compensation or refund with interest at 18%.

What did the mumbai consumer court say

The Committee noted that the purchaser’s motive was to acquire property in the tallest building in the world and that the representation made by him suggested the same.

He was promised an apartment in the 117-storey building as the brochures clearly state.

According to the complainant, the buyer was shown a lucrative color brochure and enticed by his agent that “World One” in Mumbai would be the world’s tallest apartment building with several floors for parking and 117 upper floors, FPJ reported.

He also indicated that there was a misrepresentation regarding the height of the building and that the other side did not provide any evidence that the order issued by the Airports Authority of India gives a penalty for building up to 284.29 metres. In 2013 it became a piece of general news, at the time.
