The Supreme Court on Tuesday extended until September 26 temporary bail for Union Minister Ajay Kumar Mishra’s son, Ashish, who faces trial in the 2021 Lakhimpur Charity violence case.

The panel of judges Surya Kant and Dipankar Datta noted that the trial was underway in the case and adjourned the case.

The Supreme Court said on April 24 that it may not be possible to direct the lower court to conduct daily hearings in the case because it may affect other pending cases there.

While hearing the case on 14 March, the High Court said the trial in the case had not been “slow-paced” and ordered the relevant Sessions Judge to continue to keep it updated on future developments in the trial.

The Supreme Court noted that, although it is not observing the trial, it does have “indirect supervision” over it.

It said the provisional directive contained in the January 25 order, under which provisional bail of eight weeks was granted to Ashish Mishra in the case, would continue to operate.

The court also ordered Ashish Mishra to leave Uttar Pradesh within one week of his release from prison.

On 3 October 2021, eight people were killed in Tikonia, Lakhimpur Khiri district after violence broke out when farmers were protesting against the visit of the then Deputy Chief Minister Keshav Prasad Maurya to the district.

According to the Uttar Pradesh Police FIR, four farmers were mowed down by an SUV in which Ashish Mishra was sitting. Following the accident, the sports car driver and two BJP workers were allegedly lynched by angry farmers. A journalist was also killed in the violence.

In its order of January 25, the Supreme Court exercised its “suo-moto constitutional powers” and directed four defendants – Gurinder Singh, Kamaljeet Singh, Gurupreet Singh and Vichitra Singh – who were arrested in connection with separate FIRs made on the killing of Three occupants of the SUV, which allegedly killed the farmers there, are released on temporary bail until further orders.

While granting temporary bail of eight weeks to Ashish Mishra, the court said that any attempt by him, his family or his supporters to influence or threaten witnesses, directly or indirectly, necessitated the revocation of the temporary bail.

It had said that Ashish Mishra would surrender his passport to the trial court within one week of being released on provisional bail and would only enter Uttar Pradesh to attend the trial proceedings.

The Supreme Court had also said that he would disclose his residence to the Court of First Instance as well as to the Judicial Police Station where he would remain during the temporary bail period.

“The Court of First Instance will send progress reports to this court after each hearing date, along with details of the witnesses examined on each date,” the Supreme Court said.
