A local court in Kaushambi acquitted a man who was registered in a 2018 rape case and ordered the registration of a case against the girl’s father for “retracting his recorded statement to the police”.

“The court acquitted the accused of rape and ordered a case to be registered against the girl’s father under Section 22 (Penalty for False Complaint or False Information) of the POCSO Act,” said government advocate Anil Kumar.

The prosecution said the girl’s father, Dalit, alleged in his complaint that on May 25, 2018, when he was asleep, the accused and his parents kidnapped his daughter. The prosecution said that based on the complaint, a case was registered against the man and his parents for kidnapping and criminal conspiracy.

Two months later, the police took the girl back. Based on the girl’s statement, the police added the charge of rape to the FIR, the prosecution said. After investigation, the man was charged by the police with rape and kidnapping, and under the relevant sections of the POCSO and SC/ST (Prevention of Atrocities) laws.

During the trial, the girl and her father did not support the prosecution’s accusations and retracted their statements. The girl told the court that she went with the accused alone and was not sexually assaulted. The girl also said that she was 18 years old when she ran away. After that, the court declared the girl hostile,” Kumar said.
