Tahir Hussain had applied to the Delhi High Court, seeking to annul the FIR registered against him on charges of rioting during the communal violence that broke out here in February 2020.
Former AAP board member Tahir Hussain has been granted bail by the Delhi High Court in a case related to the 2020 Delhi riots. However, the court said, even though bail was issued, he will remain in jail.
Hussain had applied to the Delhi High Court, seeking annulment of the FIR registered against him for the offense of rioting during the communal violence that broke out here in February 2020.
Hussain’s lawyer claimed that the trial had not yet started in the present case and that there was already other information about the air accidents regarding the same alleged incidents.
Judge Vikas Mahajan listed the matter for a hearing on May 25 due to the unavailability of a Delhi Police lawyer.
The judge verbally noted that there was a difference between the two cases, both of which were registered in 2020. He noted that while the current FIR is about riot allegations, the other FIR is about Section 302 (Murder) of the Indian Penal Code.
Appearing on Hussain’s behalf, attorney Tara Narula said the other FIR was “broader” and would include the existing FIR as well and that there was no “restriction” period during which one would have to petition to have an FIR rescinded.
“The alleged incident in both FIRs was a riot on February 25, 2020, between 4pm and 5pm, and that I was agitating and my roof was used for petrol bombs. The location (of the incident) in both FIRs is Himself”.
The petition stated that the current FIR was recorded on 28 February 2020, and alleged arson of shops, while the other FIR was recorded on the allegations of murder of Intelligence Bureau employee Ankit Sharma on 26 February 2020, in relation to the incidents that occurred in the vicinity of Chand Bagh, Pullia district. .
