Lucknow Municipal Council in Allahabad Markaz on Wednesday directed that a 12-year-old rape victim could undergo termination of her 25-week pregnancy after taking into account a report by a medical board in which doctors said that “continued pregnancy poses greater risk to her physical and mental health.” because of her young age.”
In its order, the panel of judges Mahesh Chandra Tripathi and Prashant Kumar said, “In view of the facts and the medical report, it would be appropriate to issue an order to terminate the pregnancy to the petitioner after considering the medical evidence.”
The court ordered District Magistrate Buland Shahar to ensure that the girl, along with her mother, reported to Aligarh Medical College on 13 July. The court also instructed the director of the Faculty of Medicine to ensure that the girl’s pregnancy is terminated, adding that the operation takes place in the presence of the head of the obstetrics and gynecology department.
The petitioner’s lawyer confirmed that the girl was deaf and dumb. The court said, “We found…that the doctors judged that continuing the pregnancy posed a greater risk to her physical and mental health…we allow the victim to undergo a medical termination of her pregnancy as soon as possible.”
