The decision asked the Supreme Court bench to reconsider its recommendation to transfer Judge Kanth
The Delhi High Court Bar Association (DHCBA) on Thursday expressed concern over the High Court bench’s recommendation to transfer Delhi High Court Judge Gaurang Kanth to the Kolkata High Court, saying such transfer would adversely affect the administration of justice due to the reduction in the current strength of judges.
The bar asked its members to abstain from work on July 17 as a token of protest, saying the transfer was a “rare rare case”.
“It is a matter of regret that although no attention has been paid by all concerned to the process of filling existing vacancies in the Delhi High Court, transfer of existing judges is taking place, with the effect of further curtailing the present strength of judges in the Delhi High Court,” a decision brought forward by its chairperson Mohit Mathur and adopted by the Bar Association.

“The DHCBA has unanimously decided to ask its members to abstain from work on Monday, i.e. July 17, 2023, as a token of protest because transfer is a rare rare event,” the resolution read.
On Wednesday, the Supreme Court Collegium decided to recommend the transfer of three justices from different supreme courts, ignoring their claims about their selection.
The collegium, which is chaired by Chief Justice of India D. Y. Chandrachod, and which also includes Justices SK Kaul, Sanjeev Khanna, PR Gavai and Surya Kant, has recommended that Delhi High Court judge Gaurang Kanth be transferred to the Calcutta High Court.
Judge Kanth filed a case on July 7, 2023, seeking transfer to the Madhya Pradesh or Rajasthan High Court, or a court in any of the neighboring states.
