The Karnataka High Court on Wednesday granted a temporary stay of the investigation and all further proceedings in a case registered against the BJP’s social media chief Amit Malviya over his allegedly offensive remarks against Rahul Gandhi.
“The Karnataka High Court has granted a temporary stay of the investigation and all further proceedings in the FIR against Amit Malviya… The said tweet was against a particular individual, Rahul Gandhi. The complaint as well as the FIR report did not mention any allegations appealing to IPC 153(A) provisions, 505 (2),” BJP MP and Advocate Tejasvi Surya, who represented Malviya in court, was quoted as saying by ANI news agency.
“The Government of Karnataka, especially after Priyank Karg assuming the position of Minister, has taken this approach of pursuing false cases, registering bogus FIRs against opposition leaders with vendetta. The discontinuance of these actions against Amit Malviya is an indication that the said FIR has been submitted with malice. , only to face political vendettas.”
Karnataka Police recorded an FIR against Amit Malviya, the head of the Saffron Party’s IT cell, via a video tweeted by the BJP leader. The FIR was filed at the Higher Lands Police Station on June 27, based on a complaint filed by Ramesh Babu, co-head of the Communications and Social Media Department at KPC.
The complainant alleged that remarks like “Rahul Gandhi is dangerous and plays a cunning game” and “The most dangerous people are the people who pull the strings of #Raga like Sam P (itroda), who are fiercely anti-India, and spare no effort to defame India abroad, just to embarrass the President Honorable Minister Narendramodi ji” was defamatory and intended to incite hatred. The video is misleading and trying to spoil sectarian harmony, I read the FIR.
Malviya is booked under IPC Section 153(A) (Promoting hostility between different groups), 120B (Criminal conspiracy), and IPC 505(2) (Statements that create or promote hostility, hatred, or ill will between classes) and IPC 34 (Acts done by several persons in furtherance of a common intent).
