Almost a week after Maharashtra Assembly Speaker Rahul Narvekar issued notices to 54 MLAs from two factions of Shiv Sena led by Uddhav Thackeray and Chief Minister Eknath Shinde, 14 MLAs from the Sena UBT submitted their responses on Tuesday.

In their responses, Sena UBT’s AML Agency stated that the notices issued to them on the ineligibility petition by Shinde led by Sena MLA Bharat Gogawale is “unlawful” as Gogawale’s appointment as chief whip itself is “unlawful”.

In the responses, the Sina Legal Businessmen Union UBT referred to the Supreme Court’s ruling in May that described Gugawel’s appointment as chief whip of Sina as illegal and that it is not the legislative party but the political party that can appoint a chief whip for the legislative party. .

We submitted our responses on Tuesday through our attorneys and have presented our side. We said in the notice that the whip issued by Gogawale did not apply to us because his appointment as Chief Whip was itself illegal. Sena UBT MLA Bhaskar Jadhav said, “The Supreme Committee in its order has described Gogwali’s appointment as illegal.”

“The Speaker issued us a notice on the petition of disqualification lodged by Gogawale. But where the appointment of Gogawale himself is not lawful, the petitions of disqualification also become void,” added Jadhav.

Last week, the Speaker issued notices to 54 MLAs which include 39 from the Shinde-led Sena and 14 from the Uddhav Sena.

The notifications were made under the rules for members of the Maharashtra Legislative Assembly (exclusion on grounds of defection) and MLAs were required to present their side in writing to the Speaker’s office within seven days, a source said.

The Sena MLAs, led by Shinde, gave their responses on Monday.

According to the officials, since the legal aid agency has responded to the notifications issued to them, the disqualification procedure will start after the ongoing monsoon cycle.
“A separate session will be given for each petition,” said an official.
