Malvia had filed a motion to dismiss the case against him at the city’s High Grounds police station
The Karnataka High Court on Wednesday suspended the investigation of the case registered against Amit Malviya, the national head of the social media wing of the Bharatiya Janata Party (BJP), for posting an insulting video against Congress party leader Rahul Gandhi.
Malvia had filed a motion to dismiss the case against him at the city’s High Grounds police station.
Judge M Nagaprasana granted a temporary stay of investigation in the case today.
He also ordered an ultimatum issued to the state government to raise its objections and adjourn the case.
The MP for Bengaluru South Tejas, Syria, who appeared for the petitioner as advocate during the trial, argued that no statement was made in the alleged video that would amount to offenses punishable under Sections 505(2) and 153A of the Iraqi Penal Code.
“There is no average in the complaint to show how the petitioner’s actions led to the commission of the alleged offenses. The FIR contested may be quashed on that basis alone,” the petition said.
Malviya on 17 June 2023 posted a video on his Twitter account with the caption, “Rahul Gandhi Videshi Taaqaton Ka Mohra? (Rahul Gandhi is a pawn of foreign forces).
Ramesh Babu, Co-Chief of Communications Department at KPC, complained on 19 June and the High Land Police registered the FIR on 27 June.
“In the video shared by Mr. Amit Malviya, Shri Rahul Gandhi was targeted for a malicious and false 3D animated video, endorsed by key BJP leaders like Mr. Amit Malviya, Mr. JP Nada and Mr. Arun Sood. The video was circulated on 17/06/2023 and dealt with Mr. Malviya on Twitter, with the clear and malicious intent of not only defaming Shri Gandhi and INC but inciting communal strife and Misrepresentation of the character of the party and its leaders, “the complaint stated.”
