Actress Jiah Khan, who was found dead in her home in June 2013, was the victim of her feelings, states the transcript of the order issued by the Central Bureau of Investigation (CBI) Special Tribunal, accessed EXCLUSIVELY by CNN-News18.
Last week, the court acquitted actor Suraj Pancholi in the case of Khan’s murder. The order was issued nearly 10 years after Khan was found dead in her home in June 2013.
The court, in the copy of the order, said that it could not be denied that the deceased Nafisa Khan aka Gia Khan had suicidal tendencies.

“Undoubtedly, the suicide of a young girl is deplorable. However, the evidence available on the record indicates that the deceased was a victim of her feelings. She could not overcome the feelings. The deceased could always withdraw from the relationship. However, she could not overcome her feelings and her love for the accused for which the accused could not be held responsible.It has been recorded that in time,the accused was pursuing his career in acting and admittedly could not devote enough time to the deceased.However, the previous time,when the deceased attempted suicide,the accused saved her He helped her get out of depression,” the order copy reads.
The court order criticized the position taken by Khan’s mother, Rabia, of “likening this case to murder.” The matter also talks about the petition filed in the Bombay High Court to refer the case to national and international agencies.

The order added that Rabia, through her testimony, tried to show that Khan never committed suicide, but rather was killed by Pancholi. But the court clearly stated, while giving the order, that there was insufficient evidence against Pancholi in instigating the suicide case, which was the reason for his acquittal.
“The complainant was the main and essential witness for the prosecution, and based on her complaint, the law was enacted. The complainant openly expressed his lack of confidence in the prosecution. When the case was about suicide, the complainant stated that it was a case of murder. However, there is no charge of intentional murder in this case The issue,” the command transcript said.

The order also added that Rabia blamed the two investigation agencies (Mumbai Police and CBI), indicating that the two investigation agencies did not conduct proper and proper investigation.
The court added that Rabia did not trust the doctors’ opinion, the autopsy report, or any kind of expert witness, which “damaged the prosecution’s case.”
According to the order, according to the opinion of experts, Khan was suicidal. “It is noted that after a long and in-depth investigation, each of the two investigating officers concluded that it was a case of suicide… Although the complainant stated that it was a case of murder, the evidence available in the record does not reflect what the complainant stated,” the judge said in the order.
