A bench composed of Justices Devan Ramachandran and Shoba Annamma Eapen conveyed their deep sorrow, stating that their hearts were in great pain, and that they had experienced sleepless nights upon viewing the dead bodies of children.
The Kerala High Court has expressed its deep shock and anguish over the devastating boat accident that took place in Tanur district of Malappuram district, which left 22 people dead, including 15 innocent children.
Describing the incident as “horrific” and “distressing,” the court initiated a Public Interest Litigation (PIL) to investigate why authorities allegedly allowed the vessel to operate in violation of regulations.
A bench composed of Justices Devan Ramachandran and Shoba Annamma Eapen conveyed their deep sorrow, stating that their hearts were so aching, that they suffered sleepless nights after beholding the dead bodies of children.
The court attributed the cause of the accident to a combination of “cruelty, greed and official indifference”, describing it as a deadly cocktail. This forced the court to take action of its own accord and initiate the Political Impeachment Act, with the primary aim of preventing such tragic incidents from recurring in the future.
Drawing attention to the alarming frequency of boating accidents in the state, the court confirmed that this issue had been a concern since 1924 when Kerala lost the famous poet Mahakavi Kumaranasan in a boatwreck between Kollam and Kottayam in Palana.
The ill-fated boat capsized near Thuvalthiram beach in Tandoor district at around 7.30pm on Sunday. District officials reported that of the 22 victims, 15 were minors, ranging in age from eight months to 17 years. The boat was carrying a total of 37 people when the tragedy occurred.
The Kerala High Court’s proactive approach through the Political Impeachment Act reflects its firm resolve to investigate the circumstances surrounding the incident and ensure that stringent measures are taken to prevent similar incidents from occurring in the future.
