TikTok filed a federal lawsuit against the state of Montana in response to a recently passed state law that bans the popular video service in the state.

suit foot Lawyers for the app’s parent company wrote that the goal of a Montana district court in the US on Monday is to “prevent the state of Montana from illegally banning TikTok.”

“Montana’s ban curtails freedom of speech in violation of the First Amendment, violates the United States Constitution in many other ways and is prohibited by federal law,” the attorneys said.

Last week, Montana became the first US state to ban TikTok over allegations that the Chinese government could use the app for intelligence-gathering operations. When the ban goes into effect on January 1, 2024, Apple and Google’s app stores will not be legally allowed to offer TikTok to users in Montana, though it’s unclear how those companies will be able to enforce the ban.

Montana Governor Greg Gianforte described The ban is an “important measure” intended to further “our shared priority to protect Montanaans from Chinese Communist Party surveillance.”

The lawsuit said TikTok rejects Montana’s claims that the Chinese government “has access to data about TikTok users, and that TikTok exposes minors to harmful content online.”

However, the state says nothing to support these allegations, and the state’s debunked speculation ignores the fact that the plaintiff has not, and will not share, US user data with the Chinese government, and has taken substantial measures to protect the privacy and security of TikTok users, including by storing all User data in the United States by default in the United States and create safeguards to protect user data in the United States,” the attorneys added.

TikTok has come under fire from US lawmakers over its alleged ties to the Chinese government. TikTok CEO Shou Zi Chew faced tough questioning from politicians in March and tried to assuage their concerns by highlighting the company’s work with the US tech giant. inspiration To develop infrastructure in Texas with the aim of storing and processing data of people in the country.

With the lawsuit, TikTok hopes the court will find Montana’s ban “unconstitutional and preemptive under federal law.”
